These Terms are a public offer and set the same conditions of the Messedo service for every user. The seller (service provider) is named in section 1.
By creating an account or using the Service, the User accepts these Terms, the Privacy policy and the Payment terms. A User who does not agree must not use the Service.
On the User's request the parties may sign a separate written agreement; where it differs from these Terms, the agreement prevails.
1. Definitions
Website — messedo.com. Dashboard — the User's account at dashboard.messedo.com, available after registration.
Service — sending SMS through the Dashboard, the API (api.messedo.com) and SMPP and, once activated by a manager, Viber messages; related Dashboard features (contacts, templates, reports, short links and others).
User — a legally capable individual, a sole proprietor or a representative of a legal entity who has created an account.
SMS part — up to 160 Latin (GSM) or up to 70 Cyrillic (Unicode) characters. Longer messages are split into parts of 153 / 67 characters, and each part is billed.
Sender ID — the name the recipient sees as the sender of an SMS: up to 11 Latin characters, digits, spaces and hyphens. Viber sender names are registered separately.
2. Registration and access
To register, the User gives a name, an e-mail address and a mobile number. The system generates the password and sends it to the User by SMS and e-mail. The User can change the password in the Dashboard (Profile) and must keep it secret.
The same password is used for SMPP; API access uses a token issued in the Dashboard. API and SMPP access can be limited to a list of IP addresses.
Anyone who obtains the User's credentials, e-mail or phone may access the Dashboard. The User is responsible for keeping the credentials safe and must tell Messedo at support@messedo.com at once if the account may be compromised. Messedo is not liable for losses from the use of the account by third parties that was not caused by Messedo.
After registration the User may receive a test balance and a test Sender ID to try the Service (see the Payment terms).
3. Messaging rules
The User complies with the law of Ukraine and of the destination countries and with operator rules, in particular has the recipients' consent and shows the real sender. Sender IDs and texts may be reviewed (moderated) before sending.
The User must not:
- send spam, phishing, fraudulent or misleading messages or impersonate anyone;
- send unlawful, threatening, abusive, obscene or discriminatory content or advertise prohibited goods and services;
- process recipients' personal data without a lawful basis;
- transmit confidential information or intellectual property without the necessary rights;
- upload malicious code, bypass technical limits or interfere with servers and networks;
- copy, distribute or resell the Service or its parts without Messedo's written permission.
Viber messages are also subject to Viber's rules on prohibited topics.
4. Prices and balance
The Service is prepaid and available while the balance is sufficient. The User's prices are shown in the Dashboard; the general price list is published on the pricing page. Every SMS sent, including through the API or SMPP, reduces the balance by the price of its parts.
Top-ups, price changes, refunds and payment disputes are governed by the Payment terms.
5. Provision of the Service and suspension
Messedo may suspend the Service for maintenance of its own systems or those of partners and operators; planned work is announced in advance where possible. Messedo may add, change or discontinue features.
Messedo may suspend or terminate the User's access if the User breaches these Terms, the law or operator rules, or creates a risk to the Service, recipients or third parties.
The User may stop using the Service at any time by requesting account deletion at support@messedo.com.
6. Personal data
Messedo processes personal data under the Ukrainian data protection law and, where EU law applies, the GDPR, as described in the Privacy policy.
For the contacts the User sends messages to, the User is the controller and Messedo processes the data on the User's behalf only to provide the Service.
7. Intellectual property
The Service, software, texts, graphics, interfaces, logos and trade marks of Messedo are protected by law and may not be sold, licensed, modified, reproduced, decompiled or used for derivative works without Messedo's written permission. Rights to message content stay with the User.
8. Third-party services
Delivery depends on mobile operators and partners; integrations (for example Altegio) and payment services (WayForPay) work under their own rules. Messedo is not responsible for resources it does not control.
9. Warranties and liability
The Service is provided "as is". To the extent permitted by law, Messedo does not guarantee uninterrupted operation or the delivery of every message, which depends on operators, networks and recipients' devices.
Messedo is not liable for indirect loss, lost profit or lost data, or for harm caused by third parties, network or operator failures or unlawful User content, unless the law provides otherwise.
The User compensates Messedo for reasonable third-party claims and losses arising from the User's content, the use of the User's account or a breach of these Terms, the law or the rights of others.
10. Changes and notices
Messedo sends service, billing and legal notices to the User's e-mail or publishes them in the Dashboard. Messedo may change these Terms; material changes are announced at least seven calendar days before they take effect unless the law requires otherwise. The current edition is always published on this page.
If a provision is found invalid, the others remain in force. The User may not assign rights under these Terms without Messedo's written consent.
11. Contacts
